Senate Votes To Reopen Black Farmers’ Lawsuit

The AP reports:

The farm bill approved by the Senate last week moved Congress a step closer to reopening a landmark discrimination case against the Agriculture Department.Like its companion bill in the House, the Senate measure would give thousands of black farmers another chance at seeking compensation over claims that they were denied loans or other crop subsidies because of their race.

Critics have charged that farmers had plenty of time to win claims under the original settlement that USDA agreed to in 1999. Reopening the matter now could cost several billion dollars and reward questionable claimants who may not have suffered losses, they argue.

But advocates for black farmers say the settlement was flawed and that many farmers living in rural areas did not know of the deadline for filing claims.

So far, the provision – tucked inside the nearly $300 billion farm bill – has not run into significant opposition on Capitol Hill. Aides said it appears likely to survive in the final version of the bill that Congress sends to President Bush.

“For far too long, this country’s hardworking black farmers were discriminated against by our own government, and this legislation offers a chance for us to continue righting those wrongs,” Sen. Barack Obama, an Illinois Democrat running for president, said in a written statement.

    I submitted a claim in 2001 for my Parents. I haven’t received any response or anything at all not even an acknowlegement of whether the claim was received. Please let me know when this reopens and let me know what I have to do to resume this. My father is deceased and my mother lives in a rural area in ALA. She didn’t know anything about it. She was not informed at all. I was visiting and forms were being distributed in her community by some person that I didn’t know so I took it upon myself in her behalf to mail the forms. Please let me know something. Thanks.

    I still have a stack of the never completed questionaire froms from the last settlement but after reading them it says this is just a questionaire. I never filed with a claim with the first one because I thought this questionaire was the application can I still file even though I may not have filed in the first settlement?

She wants to know when she can file her claim and where does she need to go to get the claim form. She wants to file on behalf of her deceased mother. She missed out the first go-round through no fault of her own. She was told that it was too late to file a claim.

    I filed a claim back in 2004, I was told by the time they received my application it was pass the dead line. I have been reading that the claims are being re-opening. How can I receive another application to re-apply.

    I farm land in Farmville, Virginia which I own now…At the time John H. and Viola Johnson owned the land. I know several people that have gotten their money, but they all live in Alabama. I have call and filled out the Black Farmer questionair to see if I qualified for this law suit I just cannot get heads and tail of what to do.. Hope to hear from someone ASAP.

    I , too filled out the forms before the deadline, but have not heard anything from anyone. My father and uncle who were farmers attended meetings in Pine Bluff, Arkansas with the Black Farmers but we have not gotten any information. I send the applications certified mail so that it was no doubt that it was sent in under the deadline.
    If we are given information on who was responsibilie for collecting the application and getting them into the proper authorities will help many to get to the bottoewof the mystery.
    At this point I would like to know what steps need to be taken?
